Gift Card Giveaway Contest Terms & Conditions
1. EMAIL OPT-IN SUMMARY TERMS & CONDITIONS: By entering to win this Giveaway you agree to receive occasional email messages from Max I. Walker. These messages may be transactional in nature (e.g. regarding orders you have placed for our services) or promotional in nature (e.g. regarding discounts or information about our services or other offerings). The volume of transactional emails you receive will depend on the frequency with which you place orders for Max I. Walker’s dry cleaning and laundry services. The volume of the promotional emails you receive will average three (3) per month. Our email messages are intended for subscribers over the age of 18 and are delivered from the address [email protected]. You may unsubscribe from our messages at any time using the unsubscribe link at the bottom of the message. Disabling all notifications will cease all emails, regardless of their nature.
2. GIVEAWAY PERIOD. The Giveaway begins November 13, 2023 at 7 a.m. CST and ends on December 23, 2023 at 4:00 p.m. CST.
3. NO PURCHASE IS NECESSARY TO ENTER OR WIN. A purchase will not increase your chances of winning. Participation constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules. Giveaway is sponsored by Max I. Walker (the “Sponsor”) who is solely responsible for all aspects of this Giveaway. There are no other sponsors or affiliations of this Giveaway.
4. ELIGIBILITY. The Giveaway is open to legal residents of the United States of America who are 18 years of age or older. Max I. Walker employees and their family members are not eligible to participate or claim the prize. Void where prohibited or restricted by law. All federal, state and local laws, rules and regulations apply. By participating, entrants agree to abide by all terms of these Official Rules and the decisions of the Sponsor, and waive any right to claim ambiguity in the Giveaway or these Official Rules.
5. HOW TO ENTER. All existing and potential Max I. Walker customers aged 18 and older will be automatically entered in Giveaway when one (1) of the following conditions is met at any time during Giveaway Period: a customer’s email address is added to an existing Max I. Walker account that contains no email address; a customer’s email address is verified, corrected or updated in an existing Max I. Walker account that already contains an email address; or a new or potential customer creates an account with Max I. Walker and provides an email address. Only one (1) Giveaway entry per person is permitted. Entrant agrees to have their information used by Max I. Walker for promotional purposes to enter to win. All entries become the exclusive property of the Sponsor. No mechanically reproduced entries will be accepted.
6. LIMITATIONS OF LIABILITY. The Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Giveaway in whole or in part, at any time, without notice and award the prize using all non-suspect eligible entries received as of this termination date. The Sponsor assumes no responsibility for any error, omission, interruption, loss, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Giveaway, or to be acting in violation of these Official Rules. Any attempt by any person to undermine the legitimate operation of the Giveaway may be a violation of criminal and civil law and, should such an attempt be made, the Sponsor reserves the right to seek damages (including attorney’s fees) and any other remedies from any such person to the fullest extent permitted by law. Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute as to the identity of a winner based on an email address, the winning entry will be declared made by the authorized account holder of the email address submitted at time of entry. “Authorized account holder” is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
7. SELECTION AND NOTIFICATION OF WINNER. Five (5) Giveaway winners will be determined by random selection from among all eligible entries on or about January 2, 2024. Winners will be notified by email on or about January 3, 2024 and need not be present to win. A winner has until 11:59 p.m. on January 10, 2024 to claim their prize. A winner will be disqualified and an alternate winner will be selected if a selected winner fails to comply with these rules; cannot be contacted; is ineligible; fails to claim the prize by the stated deadline; or if the prize notification or prize is returned as undeliverable. Acceptance of the prize constitutes permission to use a winners’ names, likenesses and statements for promotional and publicity purposes without additional compensation or limitation unless prohibited by law. All decisions of the Sponsor regarding the selection of winners, notification and substitution of winners in accordance with these Official Rules shall be binding and final.
8. PRIZE AVAILABLE. Five (5) $100 gift cards to Omaha restaurants will be awarded to five (5) winners. Gift card terms and restrictions will be defined and administered by issuing merchants. Said gift cards cannot be redeemed for cash or exchanged for another prize. Approximate retail value (ARV) of each prize is $100. Total ARV of all five prizes combined is $500. Security of gift card and its balance is the solely the responsibility of the winner. If gift card is lost or stolen, Sponsor is not responsible for replacing the lost gift card or otherwise awarding the remaining balance to the winner.
9. INDEMNIFICATION AND RELEASE. By entering the Giveaway and participating in any promotions relating thereto, each entrant agrees to release and hold Sponsor, their respective affiliates, subsidiaries, parent companies, officers, directors, shareholders, employees, agents, participating retailers and any other companies participating in the design, administration or fulfillment of this sweepstakes and their respective officers, directors, employees, and agents, harmless from any and all losses, rights, claims, injuries, damages, expenses, costs or actions of any kind resulting in whole or in part, directly or indirectly, from participation in this sweepstakes or any sweepstakes-related activity, or acceptance, possession, use or misuse of the prize or parts thereof, including without limitation personal injuries, death and property damage and claims based on publicity rights defamation or invasion of privacy.
10. TAX INFORMATION. All applicable Federal, state and local tax liabilities and any other incidental expenses, fees or costs associated with the receipt or use of the prize are the solely the responsibility of the winner.
11. WINNER’S LIST. For an Official Winner List or a copy of these Official Rules (PLEASE SPECIFY WHICH), send an email to [email protected] or send a self-addressed stamped envelope to Sponsor’s address, listed below. Winner List requests will be fulfilled after the Giveaway Period ends.
